1. Our Service

MemoryBanao provides digital photo transformation and portrait-generation services. Customers can upload photographs, select a theme or product, and receive a digitally generated portrait based on their selected product.

2. Customer Photographs

You are responsible for ensuring that you have the right, permission, or authorization to upload any photograph to MemoryBanao. You must not upload photographs or content that:

• You do not have permission to use.
• Infringes another person's copyright, trademark, privacy, or other rights.
• Contains unlawful, harmful, or abusive content.
• Is intended to impersonate, deceive, or harm another person.

MemoryBanao may refuse or cancel an order involving content that violates applicable laws or these Terms. Please refer to our Privacy Policy for information about how uploaded photographs are handled.

3. Portrait Rendering & Variations

MemoryBanao uses AI-assisted technology to create digital portraits. The final result may vary depending on factors such as:

• Quality and resolution of the uploaded photograph.
• Lighting, angle, and facial visibility.
• Image composition and selected theme features.

Because custom digital rendering results can vary, MemoryBanao does not guarantee that every generated image will exactly match a customer's reference image. We will, however, make reasonable efforts to provide an output consistent with the selected product and theme.

4. Orders

When you place an order, you are purchasing a specific digital portrait product or package displayed on the website. Orders are processed after successful payment confirmation. Once an order enters the image-generation process, the service begins immediately because the product is customized specifically for you.

5. Pricing and Payment

All prices displayed on MemoryBanao are in Indian Rupees (INR), unless otherwise stated. Payments are processed through authorized payment provider. An order is considered successfully placed after payment has been successfully confirmed.

MemoryBanao reserves the right to change product prices, offers, packages, or discounts at any time. Price changes will not affect orders that have already been successfully placed.

6. Refunds and Cancellations

Because MemoryBanao creates customized digital products and automatically starts image generation immediately upon payment confirmation, orders cannot be cancelled once payment is completed. However, if:

• Image generation fails because of a technical issue.
• The generated file is corrupted or unusable.
• We are unable to deliver the purchased product due to a technical problem.

If a generated portrait has a significant technical problem or does not properly process the customer's submitted image, MemoryBanao may offer a re-generation where appropriate. Re-generation availability may depend on the product purchased and the circumstances of the request.

8. Digital Delivery

MemoryBanao provides digital products only unless otherwise stated. Generated portraits are delivered through the customer's account dashboard, instant email download link, or direct file access.

9. Personal Use License

After successful payment and delivery, you receive a non-exclusive license to use your generated portrait for personal purposes, including:

You may not resell, redistribute, sublicense, or commercially exploit MemoryBanao's underlying templates, prompts, designs, software, or other proprietary materials.

10. Intellectual Property

The MemoryBanao website, branding, logos, product designs, templates, written content, software, and other original materials remain the property of MemoryBanao or their respective owners. Purchasing a portrait does not transfer ownership of the MemoryBanao website, software, templates, prompts, or other underlying materials.

11. Prohibited Use

You must not use MemoryBanao to:

• Upload unlawful or abusive content.
• Violate another person's rights.
• Attempt to gain unauthorized access to our systems or interfere with service operation.
• Use the service for fraudulent or deceptive purposes.
• Circumvent payment or security mechanisms or abuse the generation service.

We may suspend or terminate access where we reasonably believe the service is being misused.

12. Service Availability

We aim to keep MemoryBanao available and reliable, but we do not guarantee uninterrupted or error-free operation. Temporary interruptions may occur because of maintenance, technical problems, third-party service outages, or hosting network issues. We will make reasonable efforts to restore affected services promptly.

13. Third-Party Services

MemoryBanao depends on third-party services for payment processing, cloud storage, email delivery, hosting, and infrastructure. Temporary failures or limitations of these third-party services may affect service availability.

14. Limitation of Liability

To the extent permitted by applicable law, MemoryBanao will not be responsible for indirect, incidental, or consequential losses arising from the use of our service. Our responsibility relating to a particular order will generally be limited to providing a reasonable replacement, re-generation, or refund for the affected order, subject to applicable law.

15. Changes to These Terms

We may update these Terms & Conditions from time to time. When we make changes, we will update the "Last Updated" date on this page. Continued use of MemoryBanao after changes are posted means that you accept the updated Terms.
